Sometimes this is true, if the debt is for what the law considers to be a "necessity." This situation can be extremely important if the non-debtor spouse owns Real Estate. It is very important to speak to an attorney in this situation. |

It depends. The type of bankruptcy that is filed is very important. Chapter 7, Chapter 11, and Chapter 13 are the most common. It is very important to promptly speak to an attorney if you receive notice of bankruptcy. |

If I have a judgment against a debtor, do I need a lawyer to collect? |

Generally yes. Although some debtors may pay voluntarily after a judgment, the courts will not help to enforce the judgment. The creditor must do so, generally with the aid of an attorney. |
